Please find below a summary of my observations regarding coverage scope, key differences, and notable exclusions between the two policies:

Coverage Limits and Territorial Scope:

  • Leppard Policy
Provides global cover, with the exception of any claims arising under the laws of North America.
  • AIG Policy
Specifically lists Southern African countries (including RSA, Lesotho, Botswana, Malawi, etc.) as the territorial scope, though claims may arise internationally. However, judgments must be obtained within the listed jurisdictions.

Key Differences:

Area

Leppard

AIG

Territorial Limits

Worldwide (excluding North American laws)

Southern African focus; judgment must be from listed regions

Legal Costs

Included within the policy limit

Payable only with written consent and over and above the primary policy

Primary Policy Exhaustion

Required before cover is triggered

Required before AIG’s liability attaches

Extension if Primary Exhausts

Not explicitly stated, but implied

AIG policy steps in as primary if the underlying policy is exhausted

Common Exclusions:

  • Liability arising from aircraft use
  • Business or professional activities
  • Motor vehicle use (unless covered by the primary policy)
  • War and terrorism
  • Nuclear risks
  • Asbestos and silica exposure
  • Pollution (unless sudden and accidental)

Notable Differences in Exclusions:

Area

AIG

Not specifically addressed

Cyber Events
